This Privacy Policy (“Policy”) explains how K-Cart, Inc., together with its affiliates and subsidiaries (“K-Cart,” “we,” “us,” or “our”), collects, uses, discloses, retains, and otherwise processes personal information in connection with the K-Cart digital commerce platform, including our websites, mobile applications, application programming interfaces, connected-device integrations, and any current and future Services (as defined below), whether accessed through web, mobile, in-store, voice, or any other present and future technologies (collectively, the “Platform” or “Services”). This Policy applies to all individuals who interact with the Platform, including visitors, registered account holders, sellers, business (B2B) customers, delivery partners, advertisers, and other participants, in any manner and through any channel now known or hereafter devised.

K-Cart operates a digital commerce platform designed to support, without limitation, the discovery, listing, purchase, sale, subscription, warehousing, fulfilment, delivery, and advertising of a broad and evolving range of products and services, including but not limited to groceries, general merchandise, consumer electronics, apparel, home goods, digital products and content, subscription services, warehousing and fulfilment services, advertising services, logistics services, and business-to-business (B2B) commerce services, together with such additional products and services as K-Cart may introduce from time to time as part of its current and future marketplace offerings. References in this Policy to the “Services” should therefore be read broadly and are not limited to any single category of product, service, or business line. Section 14 (Business-Line Specific Processing Notices) sets out additional, business-line-specific information for certain Services.

1. Definitions

1.1 “Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household, including any information meeting an equivalent definition under Applicable Law.

1.2 “Processing” means any operation or set of operations performed on Personal Information, whether or not by automated means, including collection, recording, organisation, structuring, storage, adaptation, retrieval, use, disclosure, combination, restriction, erasure, or destruction.

1.3 “Platform” or “Services” means the K-Cart digital commerce platform in its entirety, including all current features, functionalities, and business lines described in this Policy (including subscriptions, digital products, warehousing, advertising, logistics, and B2B commerce), and any future products, features, functionalities, or offerings that K-Cart may develop, acquire, or make available from time to time, across any present and future technologies.

1.4 “Applicable Law” means all data protection, privacy, consumer protection, and related laws and regulations applicable to K-Cart's Processing of Personal Information in the relevant jurisdiction, as amended, re-enacted, or replaced from time to time.

1.5 “Third-Party Partner” means a seller, B2B customer, delivery partner, warehousing or fulfilment partner, payment processor, advertiser, marketing partner, analytics provider, or other third party that participates in or supports the Services.

1.6 “Business Line” means a distinct category of Services offered on the Platform, including subscription services, digital products, warehousing and fulfilment services, advertising services, logistics services, B2B commerce services, and any future marketplace services introduced by K-Cart, each as further described in Section 14.

1.7 “You” or “individual” means any natural person whose Personal Information is Processed by K-Cart in connection with the Services, including where that person acts on behalf of, or is employed or engaged by, a business customer.

2. Scope and Application

2.1 This Policy applies to Personal Information collected through the Platform, through communications with K-Cart (including customer support, surveys, and marketing communications), and through offline interactions connected to the Services, including in-person deliveries, warehouse or fulfilment-centre interactions, contact-centre interactions, and promotional events.

2.2 This Policy is drafted on a forward-looking basis so as to apply to K-Cart's current and future Services and is not limited to any specific product category, Business Line, or mode of delivery existing as of the Effective Date. As the Platform evolves, this Policy shall be construed to extend to such future products and Services on the same general terms described here, subject to any updates issued under Section 15 (Changes to this Policy).

2.3 This Policy does not apply to information Processed by Third-Party Partners under their own privacy policies, nor to any third-party websites, applications, or services linked to or integrated with the Platform, except to the extent such information is collected by or on behalf of K-Cart.

2.4 Where a specific Business Line involves materially different Processing activities from those described generally in Sections 3 to 13, Section 14 sets out additional detail applicable to that Business Line. In the event of any conflict between Section 14 and the general provisions of this Policy in respect of a particular Business Line, Section 14 governs to the extent of the conflict.
